General Terms and Conditions

1. Coverage
These General Terms and Conditions are in accordance with Danish Law. The notice requirements for information and consent for the storage of, or access to, information on end-user terminal equipment, No 1148 of 9 December 2011, are applicable for all deliveries by BUCKFAST DENMARK (Buckfast DK) to all customers.
A customer is any person who closes a legal transaction with a purpose, which can neither be assigned to his/her commercial, non-commercial or self-employed job-related activity.

2. Contract partner

3. Offer and conclusion of contract
The display of products in the online shop does not represent a legally binding offer but an invitation to order.
By selecting the “Order” button in the last step of the ordering process, you are placing a binding order for the Buckfast Queens in the shopping cart. When you place an order with Buckfast Denmark we will send you an email to confirm your order with us, giving all the details (order confirmation).
This order confirmation does not represent an acceptance of your offer, it is meant to inform you that we have received your order.

4. Claim & Returns
Our return guarantee entitles you to inform us of any problems you may have encountered with the delivery of your Queen within 3 days of having received her. We have a high regard for our products, as living creatures, and strongly recommend that you open the package and check the contents the day it is received. If any problems are identified with the delivery, please contact us as soon as possible so that we can advise you on any further action that may be taken.

4.1. Receiving a Claim
Should you file a claim, we will fully consider your explanation and replace your queen on our terms. Larger shipments will not be replaced if we consider the claim as a breach of our ethical terms of fair business or in case of repetition. The deadline for filing a claim is 30 days from the date of dispatch.

4.2. Return and withdrawal
As live queen bees are a very special product, there is no return or withdrawal options for B2C (business to consumer) and B2B (business to business) customers.

5. Prices and shipping costs
The prices mentioned on the product sites include the legal VAT and all other associated costs.

6. Delivery
Your Queens will normally arrive within 3 to 8 days from the date of dispatch. Delivery is provided by Post Denmark and the local postal service in your country.
Buckfast Denmark offers our customers special and safe shipment by registered post on payment of an additional fee for this service. This service is an option all customers can choose.

7. Customs and import charges
Any customs or import duties are charged once your parcel reaches its destination country. These charges must be paid by you as the recipient. Unfortunately, we have no control over these charges as the costs are dictated by your respective customs departments, but we are aware that custom policies and import duties vary widely from country to country. To our knowledge, there are no custom to be paid for Buckfast Queens from Denmark.

8. Payment
You have the choice between advance payment by credit card or by using PayPal. The payment will be authorized when you have placed your order.
Payment can also be executed by bank transfer. Payment instructions and an invoice are included in the shipment. The invoice is due for payment within 14 days after you have received the shipment. If you choose to use bank transfer, a handling fee of 6 € will be assigned to your invoice in order to cover our costs.

8.1 Refund
If you are entitled to a refund for an indisputable claim, and this is accepted by Buckfast DK, you will receive a confirmation in writing.
9. Reservation of proprietary rights
All goods will remain the property of Buckfast DK until they have been fully paid for.

10. Liability for defects
If any purchased Buckfast Queen shows a defect, the Customer can apply for a replacement through our customer service department. Should the replacement also be defective, the customer can withdraw from the contract in the case of a defect and claim a refund.
Buckfast DK is not liable for any damages caused after the goods have been received by the customer. Buckfast DK is not liable for lost profit or other financial losses of the customer if the Buckfast Denmark items are damaged in the post or delayed or lost in the postal service. To the extent that the liability of Buckfast DK is excluded or limited, this applies also to the personal liability of employees, representatives and assistants.
The aforementioned liability limitation does not apply, if the cause of the damage is due to deliberate intention or culpable negligence or in the case of personal injury or incorrect handling and the introduction of the Buckfast Queen.

10.1 Errors
We accept no liability for errors in text and prices.

11. Enquiry processing and usage of personal information of our customers
Information we receive from our customers as a result of orders and communications helps us to design a personal shopping experience and improve our service. We use this information for the handling of orders, delivery of goods and the execution of services as well as the handling of payment. We also use customer communication information to communicate with customers about orders or new products which could be of interest. We also use customer information to improve our store and platform, to prevent abuse of our website, or discover such abuse, or to enable third parties to carry out technical, logistical or other services at our request.

12. Applicable law
Danish law applies with the exclusion of the UN purchase law.
